Clover, South Carolina Deputy’s Use of Force Deemed Justified in March Shooting

In a recent determination regarding a tragic incident that took place earlier this year, York County’s top prosecutor declared that the shooting by a deputy in Clover was justified. Charlie Baker, 62, was shot by York County Sheriff’s Office SWAT deputy Berlin Gipson on March 3, 2024, during a tense standoff. The State Law Enforcement Division (SLED) looked into the details surrounding Baker’s death, ultimately leading to this decision.

What Happened on That Fateful Day

According to the investigation, the situation unfolded over a two-hour negotiation. Baker had positioned himself in his truck and was armed with a rifle. As deputies were approaching the vehicle, Baker reportedly pointed the firearm at them, escalating an already volatile scenario. Kevin Brackett, the 16th Circuit Solicitor, outlined the details in a letter, emphasizing the threat Baker posed to the deputies on-site. “The use of force by Deputy Gipson was both necessary and appropriate given the level of threat posed by Mr. Baker to the other officers on the scene,” Brackett noted. He further highlighted that Gipson was acting in defense of others.

It’s essential to understand the sequence of events leading up to the shooting. Before the deputies engaged, Baker seemingly placed the rifle on the dashboard of his truck. He brandished his firearm, pointing it at the officers, which ultimately led to Gipson firing a single, fatal shot.

In a statement, he said, “We want an unbiased investigation into any officer involved shooting that occurs within our agency.” Sheriff Tolson acknowledged that while Baker “made a poor choice to attempt to harm our deputies,” he was relieved that all deputies involved went home safely that day.

In incidents involving police shootings, SLED takes the lead on the investigation, allowing the office to maintain a level of impartiality. Once the SLED report is complete, local prosecutors review the findings to determine whether charges are warranted. In this specific case, no charges will be filed against Deputy Gipson, according to Brackett’s announcement. This shooting marks the first of two officer-involved incidents in the York County area during the first half of 2024. Notably, another incident occurred in April when deputies responded to a man who had barricaded himself inside a home after being wanted for kidnapping and domestic violence. In that case, SLED reported that the man was armed with a baseball bat, and a review of that shooting is currently ongoing.
