Rock Hill, South Carolina, is grappling with the tragic loss of former baseball coach Jalen Benjamin, who died in a traffic accident involving a tractor-trailer. The crash occurred on August 10 on Interstate 20 in Kershaw County, just northeast of Columbia. Recently, Benjamin’s family has filed a wrongful death lawsuit against the trucking company involved in the incident, alleging negligence on their part.
According to court documents, Benjamin was driving a pickup truck that was legally stopped when it was rear-ended by a tractor-trailer operated by Alex Cargo Inc.. The lawsuit, filed on October 8, claims that the driver of the tractor-trailer acted negligently, leading to the fatal accident.
Benjamin, age 29, had a notable career in baseball, serving as the head coach for the Legion Collegiate Academy for one season after working as an assistant coach for three seasons. His ability to connect with athletes earned him much respect and love within the community. Joel Hamilton, the family’s lawyer, stated that Benjamin’s legacy was significant, and his untimely death leaves a void that will be felt for years to come.
“The family and the community lost someone who would have touched lives for years,” said Hamilton, stressing the importance of the lawsuit in helping the family find out what happened during the tragic incident.
The wrongful death lawsuit seeks monetary damages for pain, suffering, medical expenses, and the emotional trauma experienced by Benjamin’s family. In the lawsuit, it is stated that “Jalen Benjamin suffered and met an untimely death,” and that his family has endured profound grief, sorrow, and anxiety due to the loss of his support and companionship.
The filing of a wrongful death lawsuit does not entail criminal charges but function as a civil action where one party claims another is responsible for a death due to negligence. To succeed in such cases, plaintiffs must establish that the defendant acted in a negligent manner, leading directly to the death and that damages ensued as a result. As of now, Alex Cargo Inc. has not provided any comments on the case, citing legal restrictions on discussing the incident. The suit has not yet been formally served to the defendants, and once it is, they will have a few weeks to submit a written response.
